Please read these Terms and Conditions carefully before using Bluethyme. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, please do not use our services. 

1. Acceptance of Terms

By creating an account or using any part of the Bluethyme platform (including our AI blog chatbot, newsletter generation tools, and Instagram comment automation), you confirm that you are at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or your business. 

2. Description of Services

Bluethyme provides the following AI-powered tools for content creators and bloggers: 

  • AI Blog Chatbot: An embeddable chatbot that answers visitor questions on your website based on your existing blog content. 
  • Auto-Generated Newsletters: Automatically generated newsletter content based on seasonal, festival, and holiday themes. 
  • Instagram Comment Automation: AI-powered automatic responses to comments on your Instagram posts. 
  • Content Analytics and Insights: Data and reporting on visitor questions, content gaps, and engagement trends. 

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. 

3. Account Registration

To access our Services, you must register for an account. You agree to: 

  • Provide accurate and complete information during registration. 
  • Maintain the confidentiality of your login credentials. 
  • Notify us immediately at social@bluethyme.ai of any unauthorized use of your account. 
  • Accept responsibility for all activities that occur under your account. 

Bluethyme reserves the right to suspend or terminate accounts that violate these Terms. 

4. Subscription Plans and Payment

Bluethyme offers both free and paid subscription tiers. By subscribing to a paid plan: 

  • You authorize us to charge the applicable fees to your payment method on a recurring basis. 
  • Fees are non-refundable unless otherwise required by applicable law. 
  • We reserve the right to change pricing with at least 30 days’ advance notice. 
  • Failure to pay may result in suspension or termination of your account.

5. Acceptable Use Policy

You agree to use Bluethyme only for lawful purposes. You must not: 

  • Use the platform to transmit spam, harmful, or misleading content. 
  • Attempt to reverse-engineer, copy, or reproduce any part of our technology. 
  • Use the platform to violate any applicable laws, regulations, or third-party rights. 
  • Use automated tools to scrape or extract data from our platform without prior written consent. 
  • Attempt to gain unauthorized access to any systems or networks connected to Bluethyme. 

We reserve the right to suspend access to any user found in violation of this policy. 

6. Third-Party Integrations

Bluethyme integrates with third-party platforms including but not limited to Instagram and email service providers. By using these features, you acknowledge that: 

  • You must comply with the terms of service of those third-party platforms. 
  • Bluethyme is not responsible for any changes to third-party APIs or platform policies that affect our services. 
  • You are solely responsible for obtaining necessary permissions and consents from your own audience and followers.

7. Intellectual Property

All content, software, branding, and technology on the Bluethyme platform are the exclusive property of Bluethyme and are protected by applicable intellectual property laws. 

You retain ownership of any content you provide or create through our platform. By using our Services, you grant Bluethyme a limited, non-exclusive license to process and use your content solely to provide the Services. 

You may not reproduce, distribute, or create derivative works from our platform or content without our express written consent. 

8. Disclaimer of Warranties

Bluethyme is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that: 

  • The Services will be uninterrupted, error-free, or free of viruses. 
  • AI-generated content will always be accurate, complete, or appropriate for your audience. 
  • Results from using the Services will meet your specific expectations. 

9. Limitation of Liability

To the maximum extent permitted by applicable law, Bluethyme shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Services — including but not limited to loss of revenue, data, goodwill, or business opportunities. 

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to Bluethyme in the 12 months preceding the claim. 

10. Indemnification

You agree to indemnify and hold harmless Bluethyme, its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights. 

11. Termination

Either party may terminate this agreement at any time. You may close your account by contacting us at social@bluethyme.ai. We may suspend or terminate your access immediately if you breach these Terms. 

Upon termination, your right to access the Services ceases. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will remain in effect. 

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable U.S. state where Bluethyme operates. 

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on our website. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of those changes.
